Terms of Service

1. Acceptance

By accessing or using Bespik ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time; continued use after an update constitutes acceptance.

2. Description of the service

Bespik provides AI-powered pronunciation analysis. You submit audio or video clips; we return a transcription, an IPA phoneme alignment, and a clarity score. The Service is intended for educational and professional development use only.

3. Accounts and access

• Guest access. You may use the Service without an account, subject to a daily limit of 3 practice attempts. Limits are enforced via browser session cookies.
• Authenticated access. Signing in with Auth0 grants additional practice attempts under the usage policy in effect at the time of your session. You are responsible for maintaining the security of your Auth0 account.
• Account termination. We reserve the right to suspend or terminate any account that violates these Terms, without prior notice.

4. Acceptable use

You agree not to:

• → Submit audio or video that contains illegal content, hate speech, or material that infringes third-party rights
• → Attempt to circumvent credit limits or rate-limiting mechanisms
• → Scrape, reverse-engineer, or automate requests to the Service without prior written consent
• → Use the Service to process recordings of individuals without their consent

5. Your content

You retain ownership of any audio or video you submit. By submitting content, you grant Bespik a limited, temporary licence to process it for the sole purpose of providing the Service. Audio files are not stored after transcription. Practice results (transcripts, scores) are retained for up to 30 days, then deleted automatically.

6. Accuracy disclaimer

Pronunciation scores, IPA alignments, and suggested phrases are generated by AI models and may contain errors. They are provided for educational guidance only and should not be treated as authoritative linguistic assessments. Bespik makes no warranty as to the accuracy or completeness of analysis results.

7. Intellectual property

The Bespik name, logo, software, and all content produced by us are our exclusive property or are licenced to us. You may not reproduce, distribute, or create derivative works from our content without written permission.

8. Limitation of liability

To the maximum extent permitted by applicable law, Bespik is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €10, whichever is greater.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which Bespik is registered, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.
